Terms and Conditions The following terms and conditions releases the School, Valley Farm and Trade Association, and Property Owners (Ryan and Nicole Farquhar) from liability. Upon enrollment, each family will receive a hard copy of this Release of Liability to be signed before participation in a Valley Farm and Trade Association School program. RELEASE FROM LIABILITY, ASSUMPTION OF RISK AND BINDING ARBITRATION Valley Farm and Trade Associationl, Ryan Farquhar, and Nicole Farquhar are not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any services occasioned by or resulting from, but not limited to, acts of God, structural or other degraded conditions of program site, dangers associated with or bites from animals, pests or insects, vegetation of any sort, dangers incident to recreational and farm school activities such as caring for animals, cooking, climbing trees, building nature shelters, wading in water, using sharp tools and scissors, participating in campfire activities (assisting in creating campfire, etc.), running, walking, digging, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics or the threat thereof or for any other cause beyond the direct control of Valley Farm and Trade Association. In addition, Valley Farm and Trade Association, Ryan Farquhar, and Nicole Farquhar are released from their own negligence, and participants assume all risk thereof. ASSUMPTION OF RISK Each child’s parent/caregiver on behalf of themselves and the minor(s) under their care who are enrolled in Valley Farm and Trade Association program(s), understands that Valley Farm and Trade Association facilitates learning experiences in outdoor natural, farm areas, and industrial areas. As such, some inherent unknown individual risks and circumstances can arise during Valley Farm and Trade Association programs that cannot be foreseen. Each parent/caregiver is aware that outdoor programs involve hazardous activities with a risk of illness, injury or death, which may be caused by forces of nature, animals, insects or flora, the negligence of Valley Farm and Trade Association, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. Parents/caregivers are aware that weather conditions may be severe, adverse, and/or unpleasant. In order to partake of the educational and physical benefits offered by Valley Farm and Trade Association, parents/caregivers are willing to accept the risks and uncertainty involved. Each parent/caregiver hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of Valley Farm and Trade Association and/or the Property Owners and agree to hold harmless and release Valley Farm and Trade Association and/or the Property Owners from claims of negligence. EMERGENCY MEDICAL ASSISTANCE Parents/caregivers consent to the application of first-aid or other emergency medical services to be applied to adults or children in connection with a health problem or emergency during a Valley Farm and Trade Association program, including calling 911 for an ambulance. Parents/caregivers agree to hold Valley Farm and Trade Association harmless as a result of any such injury or damage that might be incurred due to the application of treatment, medical services, or emergency medical care provided or offered. NO LIABILITY Each parent/caregiver agrees to waive liability of Valley Farm and Trade Association and the Property Owners for any accidents, injuries, delays, mishaps, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease, condition or issue, or otherwise, affiliated with Valley Farm and Trade Association or otherwise. This release and waiver extends and applies to, and also covers and includes, all unknown and unforeseen, unanticipated and unsuspected injuries, damages, loss, and liability. In no event will any parent/caregiver or interested party hold Valley Farm and Trade Association organization, program facilitators, or any other member of Valley Farm and Trade Association liable for any direct, indirect, special, incidental, or consequential damages for any use or non-use of, or reliance on, the programs. Each parent/caregiver understands the physical requirements of the activity in which their child will be participating, and asserts that the child currently has no known physical, medical or mental condition which would impair the child’s ability to participate in this program. Each parent/caregiver is willing to assume all risks that may be created, directly or indirectly, by any such condition. Each parent/caregiver hereby authorizes Valley Farm and Trade Association to arrange for any emergency medical treatment and hospitalization as may be necessary for the child because of participation in this activity without further consent. VOLUNTARY PARTICIPATION Each parent/caregiver acknowledges that they have voluntarily applied for the child to participate in Valley Farm and Trade Association programs and that they have read the description of the program as it appears in the current Valley Farm and Trade Association website and supplements or brochures relating to the program, together with all information contained in this application. Each parent/caregiver acknowledges voluntary enrollment of the child in this program with full knowledge of the hazards involved.
